Age plays an important part in Social Security disability.

Claimants who age age 50 or above often have an better chance getting SSDI benefits. This is due to the Medical-Vocational Guidelines, also called "grid rules." These rules combine residual functional capacity (RFC) , education and past work experience to direct a finding of disability.

The main advantage of being 50-plus is that the ability to perform sedentary work doesn't necessarily cause a denial, as it would in younger claimants. Also, the ability to perform "other work" in place of the claimant's past work doesn't rule out disability.

The Forsythe Firm's advocates are skilled in using the grid rules to gain approval of disability benefits. We encourage claimants age 50 or above to contact us for help with Social Security disability. We will meet with you at no cost to evaluate your case and find the best way to get your benefits for you.

Age 50-plus claimants are often able to get past due benefits or "back pay" which can help "catch up" for the months they waited on Social Security to grant benefits.

What does it cost to hire an experienced disability attorney? It costs nothing up front. You pay an attorney's fee at the end of the process--but only if you win and only if you collect past due benefits (back pay). Social Security will deduct the attorney's fee out of your past due benefits and pay it directly. If you don't win your case OR if you win but don't receive any back pay you never pay any attorney's fee. You pay only for success.

What About Expenses to Get My Claim Adjudicated?

Your attorney/advocate will pay all expenses involved in getting your case settled. You don't have to put up any money for expenses. At the end of the process--if your case is approved--you will be billed for expenses (which are usually no more than about $200). If your case is not approved, your attorney will pay all expenses for you and you will never receive a bill. So, you proceed totally without risk of financial burden.

What's the first step in getting quality representation for your case? First, call a firm dealing exclusively with Social Security, such as The Forsythe Firm. You will provide a brief history of your illness and work history on the phone. Then, you will attend a local office appointment to continue the application process. Your attorney/advocate can file your application for you and deal with Social Security on your behalf.
