DISABILITY BENEFITS IN ALABAMA

Alabama ranks 48th in the nation when it comes to getting disability benefits. Only two states are more difficult.


The initial application is reviewed by the Alabama Disability Determination Service (DDS), which is notorious for denying applications. Approximately two-thirds of applications filed in 2021 will be denied at the DDS stage.


Fortunately, there is an appeal process with several stages. You case will normally go through 3 levels of review:

  1. The application stage and review by the DDS.

  2. The Reconsideration Process, which has an even lower approval rate than DDS.

  3. Hearing by Administrative Law Judge - where your chance is about 50/50.

Only a small percentage of claimants get approved before a hearing with an Administrative Law Judge. So, you must persist.


Because disability in Alabama is such a difficult process, you'll want a top notch legal advocate. Be sure you have a fee arrangement where you pay no fees unless you win.
