Social Security disability decisions are based on the claimant's inability to work. That is based on how much functional ability the claimant still maintains. Such an opinion must come from the claimant's treating physician(s). This evaluation is NOT part of the medical record and must be obtained separately, usually by the lawyer representing the case.
Functional Capacity Evaluations (FCEs) ,also called Medical Source Statements, assess an individual’s physical and mental abilities. Therefore, they are important in Social Security disability hearings. FCEs provide a clear professional synopsis of what claimant can or cannot do in daily life. Typically, an FCE includes tests for strength, flexibility, stamina, and mental abilities. This gives a comprehensive picture of someone’s limitations. As a result, this data supports claims in disability hearings and aligns with medical records to tell a strong story.
Understanding functional capacity helps claimants show how their disability affects them. This is key for preparing for hearings and preparing for a favorable decision.
It isn't enough to prove that you have certain medical/mental conditions. You must prove that your symptoms are so severe that they limit significant functions--such as: sitting, standing, walking, pushing/pulling, lifting, concentrating, staying on task or making simple work related decisions, as examples.
A FCE or Medical Source Statement need not require a special examination. It is most helpful when your doctor, who has treated you over a significant period of time, provides his/her professional opinion about your ability to perform certain work-related functions. These opinions are never included in the doctor's routine medical records.
It is important for advocates/lawyers to work with the claimants and their doctors to obtain a Medical Source Statement. These documents often mean the difference between being approved or denied, especially when the case comes before an Administrative Law Judge for a hearing.
When you come to The Forsythe Firm for disability representation we will do everythng possible to obtain doctors' Medical Source Statements that will help support a winning case or appeal.
