Fortunately for claimants, the government strictly regulates how attorneys charge for representing Social Security claimants.
The maximum a lawyer can charge upon success of the case is 25 percent of back pay or $7,200 (whichever is less). If the claim doesn't result in back pay (past due benefits), then no fee can be charged, no matter how much the attorney worked on the case.
The attorney may charge for reasonable expenses, such as buying medical records or reports from doctors, hospitals or other providers, if the claim is approved. Taking a quick survey of my firm, I find that expenses usually range under $200.
The claimant is not required to put any money down or pay a retainer--not at my firm, at least.
So, if you don't win your claim or appeal: Pay no fee.
Win your claim or appeal: Pay the lesser of 25 percent of back pay or $7,200.
