PREPARING FOR YOUR HEARING

By the time you get to a hearing, you have already struggled with your Social Security disability case for at least 18 months. You have been denied twice. The hearing is your best chance to be approved and you must prepare carefully for it. Nothing happens by chance in a hearing. Good outcomes must be well planned.
It's my belief that most hearings are won a few days before the hearing ever takes place. They are won by careful preparation in your lawyer's office. This is absolutely critical.
What can an attorney do to give you the best chance of winning your case?
*Make sure all updated medical records have been submitted
*Personally meet with you and thoroughly prepare you for the hearing. This includes going over the types of questions that will asked, potential problems in the record, what to wear, how to conduct yourself and many other important items.
*Submit a pre-hearing or post-hearing brief on critical legal and evidentiary issues
*Advocate on your behalf by knowing the evidence and the specific law applicable to the case
*Address any post hearing issues promptly to avoid delays
There are many technical issues that only an experienced attorney/advocate will know how to handle: When is your DLI? When is your AOD? Was your recent work at SGA level? What is the legal theory of the case? Do you meet or equal a Listing? Is a favorable decision directed by one of the Grid Rules?
The hearing is usually a claimant’s best chance in the process to be successful in getting benefits. Preparation is key!
