SOCIAL SECURITY DISABILITY in 2026

There are a few changes to Social Security disability (SSDI) in 2026.


For one, the definition of Significant Gainful Activity (SGA) goes from $1,620 per month to $1,670 per month. This is the limit for wages you may earn while on, or applying for, SSDI benefits. Once you reach earnings of $1,670 per month you are considered to be engaged in SGA and are not eligible for SSDI benefits.


8 out of 10 initial Social Security disability claims will be denied in 2026 at the application level. The typical reason: "You are not disabled under our rules."


In 2026, most claimants will need 2 appeals and an appearance before an Administrative Law Judge (ALJ) to get a favorable decision (approval).


Objective medical evidence will play the key role in getting your SSDI approved in 2026. By objective medical evidence, we mean laboratory tests, X-rays, CT scans, MRIs or similar diagnostic tests--interpreted by a qualified physician. Claimants will need a consistent history of medical treatment, so seeng your doctor(s) regularly will be essential. Following medical advice is also very important (taking your prescribed medications, keeping followup appointments, etc.).


In 2026, I will see many claimants who ARE legitimately disabled but don't have the medical evidence to prove it. Without recent/current medical evidence of disability, there is almost a zero chance of getting SSDI benefits. I say that after practicing in the field for 25 years. If you don't have current medical treatment you will probably have trouble getting a lawyer to accept your case.


Here is what Social Security will require to award you SSDI benefits in 2026:


  1. Enough work credits, proving you have paid into Social Security. Most claimants must have worked at 5 years out of the past 10 years and had FICA paid out of ther pay checks (or paid with quaterly / annual income tax filings).

  2. A severe and medically determinable impairment which has lasted or will last for at least 12 straight months OR will end in death.

  3. Claimant must not be working at the rate of Substantial Gainful Activity ($1,670 per month).

  4. Must have current medical evidence to prove the onset date and severity of medical andor psychiatric conditions.
