How does Social Security disability insurance (SSDI) affect a disabled veteran?
It is often possible for a veteran to receive full VA benefits plus full SSDI benefits at the same time. It is not automatic, but it's possible. Both should be applied for.
Social Security has a different process and different rules than the VA.
Social Security has no degrees of disability. It is 100 percent total disability or nothing.
A veteran with a 100 percent permanent and total disability rating can have his or her SSDI application expedited and receive a faster decision.
Most disabled veterans, even those with 100 percent VA ratings, have their SSDI claims denied and must appeal in order to be awarded benefits. A hearing before an Administrative Law Judge (ALJ) is often required.
Getting SSDI benefits will NOT reduce or adversely affect VA disability or pensions.
The Forsythe Firm has handled hundreds of SSDI cases for disabled veterans. If your VA disability rating is 70 percent or better, you may be an excellent candidate for Social Security disability benefits. If our firm handles your case, you will never pay us a cent until you claim is won and your back pay has been recovered from Social Security. Consultations are absolutely free and witout obligation.
