USE RFC TO GET DISABILITY APPROVED

RFC is one of the most powerful tools available to get Social Security disability approved. What is it?


RFC stands for RESIDUAL FUNCTIONAL CAPACITY.


It means the most that an individual can do in spite of is or her medical impairments.


The main factor with Social Security disability is this: Are there jobs that you can still do in spite of your impairments or symptoms? If you can still work at some jobs, Social Security will not pay a benefit.


Before reaching a decision on any disability claim, Social Security must assign every claimant a Residual Functional Capacity (RFC), ranging from sedentary work to heavy work. Practically, most claims get decided on the ability to perform either sedentary or light work.


What you, the claimant, can do with regard to your RFC:


Be proactive and take a Residual Functional Capacity form to your treating physician to complete and return to you. Once it is completed and signed by your doctor, submit the form to Social Security (after you have submitted an application for benefits). This physician's statement will help Social Security to decide what your vocational limitations are. Can you perform medium, light or only sedentary work? This is a huge part of being found disabled under Social Security rules.


The RFC form is not a standard part of the Social Security application. In fact, it is extremely rare for Social Security to seek an RFC opinion except from their own in-house doctors. This puts you at a disadvantage. Your doctor knows your condition and limitations better than anyone. It is YOUR doctor that should assess your Residual Functional Capacity (RFC).


A final word. Most doctors do not have RFC forms. They may not even know what you're talking about if you ask for one. You may obtain a free RFC form from my office by getting a free initial consultation. Most attorneys/advocates who handle disability cases have RFC forms tailored to specific medical conditions. For example, there is a form for heart disease, seizures, back pain, multiple sclerosis....and many other diseases.
