One of our clients recently recovered more than $104,000 in past due benefits on a Social Security disability claim. Yes, that's a very nice back pay settlement.
It was a rather complicated case where the claimant had been denied benefits twice before. We appealed both the denials and took the case to trial. After hearing all the evidence, including our new evidence, the judge reopened both cases and approved both of them!
The moral of this real life story is this: You can never give up on a Social Security disability claim--no matter how many times it was denied. As in this case, there is a very good chance that the denials represent faulty legal decisions or just bad judgment. On appeal, justice often prevails.
When your advocate or attorney appeals a denial, you get several opportunities to strengthen your case:
You get to find and submit new evidence.
Your doctor gets to weigh in and help by providing medical opinions.
Your attorney can examine flaws in the denial(s).
You get to go before a judge who meets with you and listens to your case, then applies the law properly.
Your attorney/representative can question Social Security's experts effectively, which has never been possible before.
You can call witnesses to testify on your behalf, if appropriate.
Your attorney may submit petitions, briefs or arguments directly to the judge.
You may not recover over $100,000 as our recent client did--but most appeals involve getting a substantial amount of back pay. Basically, you are using the law to force Social Security to pay you for all the wrong decisions and misappropriations of law that they have made over the last months or years.
At the Forsythe Firm we dedicate ourselves to fighting for you. We will try to recover all the money and benefits that you deserve under the law. The Social Security system is really not set up to do that without a fight.
