WHAT MAKES YOU ELIGIBLE FOR A SOCIAL SECURITY DISABILITY BENEFIT?

SSDI is Social Security Disability Insurance. It is designed to replace part of a worker's income if he or she suddenly becomes disabled and can no longer work. The average benefit is around $1,250 per month--but can be as much as $3,011 per month. Dependents can also get a benefit.

What makes you eligible to receive a disability benefit?

  1. Earn less than $1,310 per month (as of 2021 ) in gross wages or self employment income.

  2. Have a restricted ability to perform basic work (walking, bending, lifting, following directions).

  3. Have a condition listed on the SSA’s list of disabling medical conditions, or one that is comparable.

  4. Be unable to perform your previous work (looking back 15 years).

  5. Be unable to perform any other type of work due to a medical impairment.

Social Security will most likely deny your application, even if you meet the rules for a benefit. Up to 6 out 10 initial decisions are mistakes. So, you never, ever assume that Social Security is correct when they deny a claim. More likely than not, they are mistaken.

Our job as Social Security disability advocates is to get errors corrected and get you paid. This may sound easy but it isn't. It takes time, skill and a lot of work. But it's worth it when your disability check arrives. And, you will probably qualify for Medicare, a federal health insurance program for the elderly or disabled which pays for office visits, hospitalizations and surgery.

If you have been denied disability benefits, we urge you to call the Forsythe Firm in Huntsville today. You must act urgently because the law only allows 60 days for you to challenge a denied claim. If you wait too long, there is no appeal and you've just lost thousands and thousands of dollars.
