WHO CAN GARNISH YOUR SOCIAL SECURITY DISABILITY CHECK?

Fortunately Social Security disability (SSDI) benefits cannot be garnished by creditors, including credit card companies, banks, mortgage lenders or auto finance companies. However, Social Security benefits can be garnished by the federal government, including the Internal Revenue Service (IRS). Benefits may also be garnished to satisfy a loan which is guaranteed by the federal government, such as a federal student loan. Benefits can also be garnished for delinquent child support payments.


To add additional protection to your Social Security benefits, we recommend:

  1. Do not deposit your Social Security benefits into an account with a co-owner. The Social Security beneficiary should be the only person on the account.

  2. Do not co-mingle (mix) any other funds in the account with your Social Security benefits. In other words, have an account into which you deposit only Social Security benefits.
