Here are the top 5 reasons to use an attorney if you're trying to get Social Security disability:


1. Your chance of success is at least twice as great with an attorney. National data show that claimants represented by an attorney obtain a favorable decision 60 percent of the time. Unrepresented claimants are successful only 31 percent of the time.


2. Social Security is a complex federal agency with difficult and complicated rules, regulations and requirements. The application is hard to understand and the appeal process is even harder.


3. Most claims are denied at the application level and will require 2 separate appeals to be paid. This can be a "hair pulling" experience for those who try to do it themselves. And it often fails.


4. About two-thirds of all disability claims will require a hearing before a federal Administrative Law Judge. Most judges are not interested in holding hearings with unrepresented claimants. A claimant puts himself/herself in legal jeopardy by going to a hearing unrepresented. It seldom turns out well. And you cannot re-do a hearing if you lose. Most individuals only get ONE hearing.


5. By federal law, your attorney cannot charge you any fee unless your claim is successful AND you are paid retroactive back-pay by Social Security. Simply put: If you don't win you don't pay. If you DO win, you only pay a fee if there is back pay.
